Welcome to Flying Tiger Athletics. These Terms and Conditions (“Terms”) govern your use of the Flying Tiger Athletics website, your registration for our programs (including camps, clinics, training sessions, teams, and events), your purchase of merchandise, and your participation in any activities we offer (collectively, the “Services”). By using the Services or registering an athlete, you agree to these Terms. If you do not agree, do not use the Services.

1. Who May Use the Services

The Services are intended for adults age 18 or older. If the athlete being registered is under 18, a parent or legal guardian must complete the registration, accept these Terms on the minor’s behalf, and confirm that they have the legal authority to do so. References to “you” in these Terms include both the registering parent/guardian and the minor athlete where applicable.

2. Accounts & Registration

  • You agree to provide accurate, current, and complete information during registration and to keep it updated.
  • You are responsible for safeguarding your account credentials and for all activity under your account.
  • We may refuse, suspend, or terminate a registration or account at our discretion, including for non-payment, violation of these Terms, or behavior that is unsafe or disruptive to our programs.

3. Programs, Fees & Payment

  • Program details, schedules, locations, coaches, and fees are described at the point of registration and may change. We will give reasonable notice of material changes.
  • All fees are charged in U.S. dollars and are due at the time of registration unless a payment plan is offered in writing.
  • You authorize us (and our payment processor) to charge the payment method you provide for the registration fee and any other amounts you owe.
  • If a payment fails or is reversed, we may suspend participation until the balance is paid.

4. Refunds & Cancellations

All sales are final. Registration fees, deposits, program fees, camp fees, and merchandise purchases are non-refundable. This includes, without limitation, cancellations or no-shows by the athlete, schedule conflicts that arise after registration, and removal from a program for violating our Code of Conduct.

If Flying Tiger Athletics cancels an entire program before it starts and is unable to offer a reasonable substitute, we may, at our sole discretion, provide an account credit toward a future program. Weather-related, facility-related, or other partial interruptions do not entitle you to a refund. We may, in our sole discretion, reschedule, relocate, or substitute sessions, coaches, or activities.

5. Assumption of Risk & Separate Signed Waiver

Participation in athletic activities involves inherent risks, including but not limited to physical injury, contact with other participants or equipment, and exposure to weather and facility conditions. By registering, you acknowledge these risks.

In addition to these Terms, every athlete (or their parent/guardian) is required to sign Flying Tiger Athletics’ separate Liability Waiver and Release before participating in any program. The terms of that signed waiver are incorporated into these Terms by reference. If a required waiver is not signed and returned, the athlete may not be permitted to participate, and no refund will be due.

6. Code of Conduct

Flying Tiger Athletics is committed to a safe, respectful, and positive environment for athletes, families, coaches, and staff. By participating in our programs (including as a spectator), you agree to:

  • Treat athletes, coaches, officials, staff, and other families with respect at all times.
  • Refrain from profanity, harassment, bullying, hazing, discrimination, threats, or violence of any kind, on or off the field.
  • Follow the directions of coaches and staff, including all safety, facility, and equipment rules.
  • Avoid the use of alcohol, tobacco, vaping products, or illegal drugs at any Flying Tiger Athletics activity or facility.
  • Refrain from coaching from the sidelines, interfering with officials, or otherwise disrupting practices, games, or events.

Violations may result in warnings, removal from a session or program, suspension, or permanent ban — without refund. Serious incidents may be reported to facility operators, leagues, or law enforcement as appropriate.

7. Photo & Media Release

By participating in our programs, you grant Flying Tiger Athletics and its representatives the irrevocable right and permission to photograph, video record, and audio record athletes, parents, and spectators during programs and events, and to use those photos, videos, recordings, names, voices, and likenesses (collectively, “Media”) in connection with our promotional, marketing, educational, and commercial activities. Media may be used in any format and any channel, including our website, social media, advertisements, brochures, and email campaigns.

You agree that no compensation is owed for the use of Media and that you release Flying Tiger Athletics and its representatives from any claim related to the Media. If you do not consent to this release for yourself or your athlete, you must notify us in writing at the email address in Section 16 before participating, and we will make reasonable efforts to avoid identifiable use of that individual’s Media. Group photos and incidental background imagery may not always be avoidable.

8. Merchandise & Store Terms

If you purchase apparel, gear, or other merchandise through Flying Tiger Athletics:

  • Sizing & descriptions: Product details, colors, and sizing are described as accurately as possible, but actual items may vary slightly. Please review size charts before ordering.
  • Order acceptance: We reserve the right to refuse or cancel any order, including for pricing errors, inventory issues, or suspected fraud, and to issue a refund in those limited cases.
  • Shipping: Shipping times are estimates, not guarantees. Risk of loss passes to you when the carrier accepts the package. We are not responsible for carrier delays, loss, or damage in transit.
  • Custom & team orders: Custom, personalized, or made-to-order items (including team uniforms and printed apparel) are final sale and cannot be returned or exchanged unless the item is defective or incorrect due to our error.
  • Returns: Consistent with Section 4, all sales are final. We will, at our discretion, replace or refund items that arrive defective or incorrect if reported within 7 days of delivery with photos of the issue.
  • Sales tax: Applicable sales tax will be added at checkout.

9. SMS / Text Messaging

If you provide your mobile phone number and opt in, you may receive text messages from Flying Tiger Athletics, including operational alerts, transactional messages, marketing messages, and two-way support replies. Your use of our SMS program is governed by the SMS section of our Privacy Policy, which is incorporated into these Terms by reference. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help.

10. Intellectual Property

The Flying Tiger Athletics name, logo, website content, photos, videos, training materials, and program designs are owned by Flying Tiger Athletics or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, modify, sell, or create derivative works of our content without our prior written permission, except for limited personal, non-commercial use.

11. User Content

If you submit content to us (for example, comments, testimonials, social media posts tagging us, or photos shared with us), you grant Flying Tiger Athletics a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, display, and distribute that content in connection with our Services and marketing. You represent that you have the rights necessary to grant this license.

12. Disclaimer of Warranties

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, Flying Tiger Athletics disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation of the website. We do not guarantee any particular athletic outcome, skill improvement, or selection to any team, league, or roster.

13. Limitation of Liability

To the maximum extent permitted by law, Flying Tiger Athletics, its owners, officers, employees, coaches, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or related to the Services, your registration, or your participation in any program, even if we have been advised of the possibility of such damages.

In no event will our total liability to you for all claims arising out of or related to the Services or these Terms exceed the total amount you paid to Flying Tiger Athletics in the twelve (12) months preceding the event giving rise to the claim. Nothing in this Section limits any liability that cannot be limited under applicable law. This Section is in addition to, and does not replace, the separate signed Liability Waiver and Release referenced in Section 5.

14. Indemnification

You agree to defend, indemnify, and hold harmless Flying Tiger Athletics and its owners, officers, employees, coaches, contractors, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Services, (b) your or your athlete’s participation in any program, (c) your violation of these Terms, or (d) your violation of any law or the rights of a third party.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. You agree that any dispute arising out of or related to these Terms or the Services will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to personal jurisdiction and venue in those courts. The parties waive any right to a jury trial to the maximum extent permitted by law.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective Date” at the top of the page and, if changes are material, provide additional notice. Your continued use of the Services after the changes take effect means you accept the updated Terms.
